TERMS OF USE — WAKESTREAK

These terms apply to the Wakestreak iOS application by Studio 073X e.K. ("we", "us"). By using the app you accept them.

1. APPLE STANDARD EULA

The app is licensed to you under Apple's standard Licensed Application End User License Agreement ("Standard EULA", apple.com/legal/internet-services/itunes/dev/stdeula) together with Apple's Media Services Terms. These app-specific terms supplement — and never replace — the Standard EULA. If a provision here conflicts with the Standard EULA, the Standard EULA prevails for App Store distribution.

2. SUBSCRIPTIONS

  • The game, statistics and community features require an auto-renewable subscription (weekly, monthly or yearly, each with an introductory free trial when eligible).
  • Payment is charged to your Apple ID at confirmation of purchase. The subscription renews automatically unless cancelled at least 24 hours before the current period ends. Manage or cancel in your device's Settings → your name → Subscriptions.
  • A free trial converts to a paid subscription unless cancelled at least 24 hours before it ends. Unused trial time is forfeited when a subscription is purchased.
  • The alarm always rings with or without a subscription. Only game, statistics and community features are subscription features.

3. THE ALARM AND HEALTH DISCLAIMER

  • The app is an alarm application. It is not a medical device, not a sleep-treatment product, and not medical advice. Nothing in the app diagnoses, treats or prevents any condition. If you rely on an alarm for medical or safety purposes, always keep a backup.
  • Alarm delivery uses Apple's AlarmKit on iOS 26 or later. Delivery depends on system services outside our control (device state, iOS version, permissions). We provide the app "as is" as far as the law allows — liability is limited per the Standard EULA and applicable statutory law (including the German Bürgerliches Gesetzbuch's mandatory provisions on intent and gross negligence).
  • The streak, statistics and scores are a game. A "verified morning" is a game event, not a health measurement.

4. ACCEPTABLE USE

  • Do not manipulate the app's verification, streaks or community data.
  • Do not use handles or content in the community feature that are unlawful, harassing or infringing. We may remove community content that violates these terms.
  • Do not resell, redistribute or reverse-engineer the app beyond legal rights.

5. YOUR DATA

Your data is processed as described in the Wakestreak privacy policy. In short: local-first, your iCloud, no accounts, no advertising, no tracking.

6. CONSUMER DISPUTE RESOLUTION

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG). The EU Online Dispute Resolution platform has been discontinued; Apple's App Store complaint channels and the ordinary courts apply.

7. CONTACT AND RIGHT OF WITHDRAWAL
